Liability For Suffolk County Car Accidents
Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the National Safety Council, “in 2020 most pedestrian traffic deaths occurred in urban settings (80%), on the open road (76%) versus intersections (24%), and during dark lighting conditions (76%). The largest number of pedestrian deaths occur on Saturdays (1,005), and the majority of these deaths happen during dark lighting conditions (821).” There are a number of steps that should be taken after any collision.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
The vast majority of pedestrian accidents are totally preventable and involve some amount of human error. All drivers are supposed to exercise due care to avoid hitting pedestrians. If a driver fails to slow down and hits a pedestrian, this could form the basis of a negligence claim.
