Pedestrian Killed In Queens Police Car Accident

QUEENS, NEW YORK (March 15, 2023) – A pedestrian has tragically died in a Queens car accident with a police vehicle by Beach Channel Drive and Bay 32nd Street.

New York City police officials are saying that the accident took place around 8:30 p.m. on Friday. A police officer was traveling down the road when it collided with a vehicle.

The force of the impact sent the other vehicle into a female pedestrian. Paramedics were called to the scene of the collision in order to help the victim.

Despite life-saving measures the woman died due to the severe nature of her injuries. A full investigation into the crash remains ongoing at this time.

Liability For Queens Police Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2020, speeding was a contributing factor in 29% of all traffic fatalities.” There are a number of other factors that could contribute to a car accident.

  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Vehicle systems failures

A police department could be liable if one of their officers is involved in a fatal pedestrian collision. According to New York Vehicle and Traffic Law 1104(e), the drivers of authorized emergency vehicles have a duty to operate their vehicle with due regard for the safety of all persons. When an officer shows a “reckless disregard” for the safety of others they could be liable for an accident during a police pursuit. There are a number of steps that should be taken after any fatal accident with a police vehicle.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • Dash cam footage from the police officer involved should be reviewed.

Losing a loved one in a car accident is often the most difficult thing that a person will go through. It is important that accident victims know that they do have rights. The family of any person that is killed in a police vehicle accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the costs that come with the sudden loss of a loved one.
