Liability For Northumberland Pedestrian Accidents
Pedestrians are much more likely to be hit during the later evening hours when they are less visible. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a driver fails to reduce their speed in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. There are a number of factors that could contribute to a car accident.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
The driver responsible for any fatal collision could be held accountable through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Sadly, though, drivers will often fight hard to deny liability for any collision. It is important that all evidence is preserved after any collision.
