Liability For Macedon Pedestrian Accidents
Thousands of pedestrians are killed every year in car accidents. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” There are a number of steps that drivers should take in order to avoid hitting pedestrians.
- Drivers should slow down during periods of inclement weather.
- Drivers should check their blind spots before making turns.
- Drivers should yield the right of way to pedestrians crossing the street.
If a truck driver was working at the time of a collision, the company that they were working for could be held at fault. Under the legal doctrine of respondeat superior employers are principally responsible for the negligent actions of their employees. According to Judith M. v. Sisters of Charity Hosp., 93 N.Y.2d 932, 933 (1999) respondeat superior will apply “so long as the tortious conduct is generally foreseeable and a natural incident of the employment.” The family of any person that died in a truck accident may be able to seek some measure of aid through a wrongful death claim.
