Liability For Commack Pedestrian Accidents
Pedestrians are uniquely vulnerable to car accidents. They lack the protection of enclosed vehicles and are much more likely to be overlooked. According to the New York State Department of Health, “Injuries to pedestrians are among the top 10 leading causes of injury-related hospital admissions and death for almost all age groups In New York State. Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” There are many steps that drivers should take to avoid hitting pedestrians.
- Drivers should slow down during the early morning and late evening hours when visibility is reduced.
- Drivers should maintain a good deal of separation from pedestrians walking along the road.
- Drivers should abstain from alcohol and other intoxicating substances.
All drivers have a legal obligation to take steps in order to avoid hitting pedestrians. Pedestrian collisions are much more likely to occur at intersections when drivers are making turns. If a driver fails to slow down to avoid hitting any pedestrian, this could form the basis of a negligence claim. The family of any person that died in a pedestrian accident may have legal recourse through a bodily injury claim. A pedestrian accident attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
