Pedestrian Died In  Port Jefferson Station Car Accident Along Nesconset Highway

LONG ISLAND, NEW YORK (January 10, 2022) – A pedestrian has tragically died in a Port Jefferson Station car accident on Nesconset Highway.

New York City police officials are saying that the accident took place around 7:40 p.m. on Thursday, January 6th, 2022. The pedestrian was walking when he was hit by a 2019 Honda.

After the pedestrian was thrown to the ground he was then hit by a Volkswagen. Paramedics were called to the scene of the collision in order to help the victim.

Despite life-saving measures, the pedestrian was pronounced dead at the scene by the Office of the Suffolk County Medical Examiner. An investigation into the Port Jefferson Station collision remains ongoing at this time.

Liability In Long Island Pedestrian Collisions

Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked by drivers. According to the Centers For Disease Control, “an estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could potentially contribute to pedestrian collisions.

  • Speeding
  • Drunk driving
  • Distracted driving
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle & Traffic Law § 1146(a), drivers must take measures to avoid hitting pedestrians, domestic animals, and bicyclists in the roadway. Drivers must also obey all speed limits. When a driver fails to exercise due care and hits a pedestrian, they can be held accountable through a negligence claim. There are a number of things that should be done after a pedestrian accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in a pedestrian accident may be able to seek aid through a wrongful death claim. Damages can help cover lost wages, medical bills, and pain and suffering. In order to win a civil claim, plaintiffs will have to demonstrate negligence. This can be very difficult. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
