Liability For Gramercy Pedestrian Accidents
Speeding remains one of the leading causes of car accidents. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2021, speeding was a contributing factor in 29% of all traffic fatalities.” There are a number of other factors that could contribute to a pedestrian collision.
- Distracted driving
- Poor road conditions
- Driver fatigue
- Inclement weather
The vast majority of pedestrian accidents are avoidable and involve some amount of driver error. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. When a driver fails to slow down to avoid a collision, this could form the basis of a negligence claim. The family of any person that died in a car accident may be able to seek some measure of justice through a wrongful death claim.
