Liability For Genesee County Truck Accidents
Dump trucks can be particularly dangerous to pedestrians for many reasons. They have large blind spots that can easily obscure the presence of pedestrians and bicyclists. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” There are a number of steps that dump truck drivers should take in order to avoid hitting pedestrians.
- Dump truck drivers should get out of their truck and check what is behind them if they can’t see.
- Dump truck drivers may need to use their horn to alert pedestrians of their presence.
- Dump truck drivers should be well rested before heading out onto the road.
Dump truck drivers will typically need to get a commercial license and are held to a high standard in terms of safety. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a dump truck driver fails to check their blind spots before hitting a pedestrian, this could form the basis of a negligence claim. There are a number of factors that could contribute to a pedestrian collision.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
The company that a dump truck driver worked for could also be liable for a collision. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. The family of any person that died in a truck accident may have legal recourse through a wrongful death claim. It is important that all evidence is properly preserved after any collision.
