The male pedestrian was attempting to cross the road when he was hit by a 2016 Toyota Tacoma pickup truck.Paramedics were called to the scene of the accident to help the victim. He was transported to Peconic Bay Medical Center in critical condition.Unfortunately, he was pronounced deceased at the hospital. A full investigation into the cause of the crash remains ongoing.Liability for Suffolk County Pedestrian AccidentsEvery person operating a motor vehicle in New York has a legal obligation to use caution to avoid colliding with any pedestrian that they encounter. Pursuant to New York Vehicle and Traffic Law \u00a7 1146, drivers must slow down and use their horn when necessary to avoid hitting any pedestrian. They must be particularly cautious around any child or obviously confused person. Courts will take into consideration many different items when evaluating liability for a traffic accident.Courts will consider the speed of the vehicle involved.Courts will examine surveillance and traffic cameras to determine who had the right of way.Courts will consider whether or not a driver attempted to brake and if they had sufficient space to come to a safe stop.Courts may look at the phone records and other evidence to determine whether or not a driver may have been distracted.If a driver fails to slow down to avoid colliding with any pedestrian in the roadway, they could be held legally responsible for any resulting injuries. Depending on the unique facts of any case, liability could extend beyond one driver determined to be at fault. Consider, for example, Liying Qian v. Eggens, 245 A.D.3d 809\u00a0(2026). A pedestrian was struck by a police vehicle that was making a prohibited left turn in Queens.
