Liability For East Harlem Car Accidents

Trucks are involved in a disproportionate number of fatal collisions. According to the IIHS, “A total of 4,714 people died in large truck crashes in 2021, a 17 percent increase compared with 2020. Sixteen percent of these deaths were truck occupants, 68 percent were occupants of cars and other passenger vehicles, and 15 percent were pedestrians, bicyclists or motorcyclists.” There are a number of steps that truck drivers should take in order to avoid hitting pedestrians.

  • Truck drivers should check their blind spots before making turns.
  • Truck drivers should be well rested before starting their shifts.
  • Truck drivers should slow down in areas with heavy pedestrian traffic.

All truck drivers must exercise due care in order to avoid causing accidents. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a driver fails to reduce their speed in order to avoid a collision, this could form the basis of a negligence claim. There are a number of steps that should be taken after any truck accident.

  • Eye witnesses should be interviewed.
  • The truck drivers logbook should be examined.
  • The truck driver’s driver record should be reviewed.
  • A thorough investigation should be conducted.

Truck drivers need to get a commercial license and are held to a high standard in terms of safety. The vast majority of pedestrian collisions involving trucks are preventable. The family of any person that died in a collision may have legal recourse through a wrongful death claim.
