Liability For Albany Pedestrian Accidents

All drivers must use caution to avoid causing accidents. Pursuant to New York Vehicle & Traffic Law § 1146(a), all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. This is true even if a pedestrian is outside of a marked crosswalk. There are a number of steps that should be taken after any pedestrian collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

The family of any person that is killed in a pedestrian accident may have recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is important that all evidence is properly preserved after any collision. Evidence is what will ultimately be used to determine liability.
