Liability In Genesee County Pedestrian Accidents
Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians. According to New York Vehicle & Traffic Law § 1146(a), all drivers must take steps to avoid pedestrians in the roadway. This includes slowing down in areas with heavy pedestrian traffic. Most pedestrian collisions happen in the early morning hours and the late evening. There are a number of steps that drivers and pedestrians can take to help reduce collisions.
- Pedestrians can make themselves more visible by wearing bright clothing.
- Pedestrians should try to only cross the road at marked intersections.
- Drivers should avoid ingesting alcohol or drugs before driving. Many people assume that if they only take small amounts of alcohol they will be ok to drive. This is never the case.
- Drivers must reduce their speed in accordance with prevailing conditions of the roadway to avoid pedestrians.
If the driver of a truck was working at the time of a collision, the company that they were working for could be held at fault. Many pickup trucks are used for commercial purposes. Any person that is injured in a car accident may be able to seek damages through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A New York pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
