Liability For New York City Pedestrian Accidents

Semi-trucks can weigh as much as 80,000 lbs and are particularly dangerous to pedestrians. According to the IIHS, “A total of 4,014 people died in large truck crashes in 2020. Fifteen percent of these deaths were truck occupants, 68 percent were occupants of cars and other passenger vehicles, and 16 percent were pedestrians, bicyclists or motorcyclists.” There are a number of steps that truck driver should take to avoid hitting pedestrians.

  • Truck drivers should continuously scan the road ahead of them.
  • Truck drivers should be well rested before the start of their shift.
  • Truck drivers should abstain from alcohol and other intoxicating substances.

When a truck driver is negligent and kills a pedestrian, they could be held at fault through a civil claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Unfortunately, it is common for truck drivers to deny liability after any collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
