Liability In New York City Hit-And-Run Collisions

Thousands of people are killed or seriously injured every year in pedestrian accidents. According to one report from the Centers for Disease Control, “an estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could potentially contribute to a pedestrian collision including:

  • Speed
  • Driver distraction
  • Alcohol use
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle & Traffic Law § 1146(a), drivers must take steps to avoid pedestrians, bicyclists and domestic animals in the roadway. Drivers must also regulate their speed in accordance with what is safe for the prevailing conditions. Fleeing the scene of a collision can create criminal liability for a driver as well. There are a number of important steps that need to be taken after any accident.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • Fragments of the vehicle that fled should be examined.
  • Eye witnesses should be interviewed.

Any person that is injured in a car accident may be able to seek aid through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. It is important to continue to seek medical care after any collision. A personal injury attorney can examine all of the unique facts of your case and let you know what your options are.
