Liability In Bronx Crane Collapse Accidents
Crane collapses may seem like freak occurrences, but they are actually quite common. According to the Bureau of Labor Statistics, “From 2011 to 2017, the Census of Fatal Occupational Injuries (CFOI) reported 297 total crane-related deaths, an average of 42 per year over this 7-year period. Men accounted for 293 of the 297 fatal injuries involving cranes. White, non-Hispanic workers accounted for 72 percent of fatal injuries involving cranes, while 15 percent involved Hispanic and Latino workers.” There are a number of common causes of crane collapses.
- Cranes may collapse when their allotted weight limits are exceeded.
- Improper crane assembly could also lead to a collapse.
- Contact with electrical lines may cause a crane to unexpectedly buckle.
There could be numerous sources of liability for any crane collapse accident. The company of the worker that assembled or operated a crane prior to an accident could face liability. Generally speaking, companies are vicariously liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. The vast majority of crane collapse accidents involve some amount of human error. Victims of crane accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Any person that is injured in a crane collapse may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. Sadly, though, construction companies will often fight extremely hard to deny liability for any crane collapse. A construction accident attorney can examine all of the facts of your case and let you know what your legal options are.
