MANTUA TOWNSHIP, NEW JERSEY December 13, 2021) – A 21-year-old woman has tragically died in a truck accident along Route 55.

Liability In New Jersey Truck Accidents

There are a number of factors that could potentially contribute to a semi-truck accident. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are a number of ways that semi-trucks can be especially dangerous.

  • Commercial trucks have very high centers of gravity which make underride collisions more likely.
  • Commercial trucks can weigh as much as 80,000 lbs.
  • Commercial trucks can take the length of two football fields to come to a stop.

Truck drivers must get a commercial driver’s license and are held to a high standard  in terms of safety. Many collisions are due to truck drivers that fail to check their blind spots and make dangerous lanes changes. Pursuant to New York Vehicle Code 1128(a), “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” Victims of semi-truck accidents often suffer very serious injuries including.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

When a truck driver is negligent and kills someone, they can be held accountable through a wrongful death claim. Typically, a victim’s next of kin will be the ones who can pursue a civil claim. Damages can help cover lost wages, medical bills and funeral costs. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
