Liability In New York Car Accidents

Car accidents are one of the leading causes of injury and death in the United States. According to the Centers for Disease Control, “more than 32,000 people are killed and 2 million are injured each year from motor vehicle crashes. In 2013, the US crash death rate was more than twice the average of other high-income countries.” There are a number of steps that drivers and passengers can take in order to be safe.

  • Every person in a car should wear a seatbelt.
  • All drivers should obey posted speed limits.
  • All drivers should abstain from alcohol or substances that could impair them.

All drivers must use caution in order to avoid causing car accidents. Many collisions are due to drivers that make dangerous lane changes. Pursuant to New York Vehicle Code § 1128, no person shall change the course of their vehicle from the lane they are in unless such a movement can be done safely. If a driver makes an unsafe lane change, they could face civil liability in the event of a collision. Victims of car accidents often suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Victims of car accidents are protected by a number of laws. The family of any person that died due to the negligence of another driver may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden and tragic loss of a loved one. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
