Liability For Colesville Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured in car accidents every year. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” Drivers should take a number of precautions to avoid hitting pedestrians.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should continuously scan the road ahead of them for hazards.
  • Drivers should use their horn when necessary to alert pedestrians of their presence.

According to New York Vehicle & Traffic Law § 1146(a), drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. The family of any pedestrian killed in a car accident may have legal recourse through a wrongful death claim. It is important that all evidence related to a car accident is properly preserved.
