Liability In New York City DUI Car Accidents

Even small amounts of alcohol can substantially impair a person’s ability to operate their vehicle safely. According to one report from the Centers for Disease Control, there are a number of ways that even three alcoholic beverages can impair someone. This can include episodes of reduced coordination, impaired judgment and lowered alertness. But alcohol is not the only substance that can potentially impair someone.  Victims of DUI car accidents tend to suffer very serious and costly injuries including:

  • PTSD
  • Head injuries
  • Lacerations
  • Broken bones

People often drive drunk dozens of times before they eventually get caught or cause an accident. Pursuant to New York Vehicle and Traffic Law § 1192.2, drivers may not operate a motor vehicle with a BAC of 0.08% or higher. Any person that is in a commercial vehicle cannot drive with a BAC of 0.04% or higher. They are not even supposed to start their shift with a BAC of 0.02%. Any driver that causes a collision while intoxicated can be held accountable through both a criminal and civil claim. Drivers convicted of DUI can face a number of punishments including:

  • Jail time
  • Fines
  • Driver’s license revocation
  • Higher insurance rates

The family of any victim that died in a wrongful death claim can seek aid through a wrongful death claim. If a victim survives for some period after an accident their family may also be able to pursue a survival action. It is important that evidence is properly preserved after an accident. A New York wrongful death attorney can examine all of the unique facts of your case and get to the bottom of what caused an accident.
