Liability For West Hempstead Truck Accidents
Commercial trucks are typically very difficult to control. There are many potential factors that could contribute to a truck accident. According to the Federal Motor Carrier Safety Administration, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are many steps that truck drivers can take in order to avoid causing collisions.
- All trucks should be well maintained and regularly inspected.
- Truck drivers should use commercial GPS systems to help plan their routes.
- Truck drivers should not be pushed to complete their routes faster than can be achieved safely.
Truck drivers must get a commercial driver’s license (CDL) and are held to a very high standard in terms of safety. Driving a commercial truck is very different from operating a passenger vehicle. That’s why proper training and certification are so important. Many truck accidents occur when truck drivers rear-end other vehicles. These types of collisions nearly always take place when a truck driver was speeding, distracted or following the lead vehicle too closely. There is typically a presumption of negligence on the part of drivers that rear-end other vehicles. Many steps should be taken after any truck accident.
- Photos of the accident site should be taken.
- Both of the vehicles involved should be examined.
- A truck’s event data recorder (EDR) should be examined.
- Eye witnesses should be interviewed.
- An experienced truck accident attorney should be consulted.
The FMCSA requires commercial trucks to carry at least $750,000 – $5,000,000 worth of liability insurance. Any person that is injured may be able to seek aid through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
