Liability For Wellsville School Bus Accidents
Buses tend to be very safe for their passengers. But they can be very dangerous for pedestrians and those in smaller vehicles. According to the National Safety Council, “From 2012 to 2021, about 70% of the deaths in school bus-related crashes were occupants of vehicles other than the school bus, and 16% were pedestrians. About 5% were school bus passengers, 5% were school bus drivers, and 3% were pedalcyclists.” There are many steps that bus drivers should take to avoid collisions.
- Bus drivers should check their blind spots before making turns.
- Bus drivers should be well rested before they start their shift.
- Bus drivers should continuously scan the road ahead of them for hazards.
All bus drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to New York Vehicle Code 1180, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to exercise due care and hits another vehicle, this could form the basis of a negligence claim. Victims of car accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Organ damage
- Lacerations
The vast majority of school bus collisions are completely preventable. They tend to involve traffic infractions and other mistakes. It is important for accident victims to understand that they do have rights. Any person that is injured in a Wellsville school bus accident may have legal recourse through a civil claim.
