Liability For New York Motorcycle Accidents
Thousands of people are killed or seriously injured every year in motorcycle accidents. According to the CDC, “Every year there are thousands of deaths and injuries to motorcyclists involved in crashes. More than 5,500 motorcyclists died on our nation’s roads in 2020, and more than 180,000 were treated in emergency departments for crash injuries.” There are a number of steps that drivers should take in order to avoid motorcycle accidents.
- Drivers should slow down during periods of inclement weather.
- Drivers should check their blind spots before making turns.
- Drivers should be well rested before heading out onto the road.
The vast majority of rear-end collisions are preventable and involve some amount of human error. They tend to involve drivers that are speeding. Pursuant to New York Vehicle Code § 1180, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. There is simply no reason a driver should ever rear-end another vehicle in their own lane. There are a number of steps that should be taken after any car accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
If a pickup truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person that is injured in a car accident may have legal recourse through a bodily injury claim.
