Nina Dever Killed In Glens Falls Car Accident On Broad Street

WARREN COUNTY, NEW YORK (February 10, 2022) – A 71-year-old woman identified as Nina Dever has tragically died in a car accident on Broad Street.

Warren County officials are saying that the accident took place around 5:45 a.m. on Sunday. Nina Dever was walking when she was hit by a dark colored SUV.

Paramedics were called in order to help the victim. Despite life-saving measures she died due to the severity of her injuries. Police described the roadway where the accident took place as dark.

Liability In Glens Falls Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in car accidents. According to the Centers for Disease Control, “an estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” Elderly pedestrians and children tend to be at greater risk of being involved in collisions. There are a number of factors that should potentially contribute to a Glens Falls pedestrian accident.

  • Speeding
  • Poorly lit roadways
  • Driver distraction
  • Inclement weather
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle & Traffic Law § 1146(a), drivers must take care to not hit pedestrians, bicyclists and domestic animals in the roadway. They must slow down when pedestrians are close enough to pose a potential hazard. If a driver hits a pedestrian after driving past a yield sign without stopping, this may be considered prima facie evidence of their failure to yield. There are a number of steps that should be taken after any pedestrian collision.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and funeral costs. Sadly, though, insurance companies will fight extremely hard  to deny liability for an accident. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
