Nicholas Bellman Injured In Alexandria Truck Accident On State Route 26 and County Route 2

JEFFERSON COUNTY, NEW YORK (November 7, 2022) – A motorcyclist identified as Nicholas Bellman was injured in an Alexandria box truck accident on SR 26 and County Route 2.

Jefferson County police officials are saying that the accident took place around 2:50 p.m. on November, 2. Nicholas Bellman was heading down the road on his motorcycle when a box truck driver turned left in front of him.

The motorcyclist was unable to avoid the collision and hit the box truck. Nicholas Bellman was airlifted to Upstate University Hospital in Syracuse.

New York State Police issued the box truck driver tickets for the unlicensed operation of a motor vehicle and for failure to yield the right of way at a stop sign. A full investigation remains ongoing at this time.

Liability For Jefferson County Truck Accidents

All drivers have a legal obligation to exercise due care in order to avoid causing collisions. Many car accidents are due to drivers that make dangerous left turns. Pursuant to New York Vehicle Code § 1141, any driver intending to turn left must yield the right of way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard. If a driver makes an abrupt left turn in front of a motorcyclist, this could form the basis of a negligence claim.

Rental companies cannot rent a truck to someone visibly intoxicated nor can they rent to someone that may lack the proper license or certification. Renting a truck to someone who is unlicensed could form the basis of a “negligent entrustment” claim. In short, negligent entrustment occurs when the supplier of a qualified product gives the product to a person whom they know (or should have known) is likely to use that product in a manner which is unreasonably dangerous.
