New York Cracks Down on Hit-and-Run Drivers

Getting into a car accident can be tragic for both the victim and his or her family members. However, when the at-fault party flees the scene of the accident, it compounds the stress by creating more emotional, mental and financial stress for the victim.

Individuals who leave the scene of an accident (commonly referred to as a hit and run accident) can face serious consequences under the law. In fact, new legislation, which was recently passed by the New York State Senate, strengthens penalties for hit and run accidents.

The Numbers Keep Rising

Each day, New Yorkers hear about multiple cases of reckless drivers who injure or claim the lives of innocent victims and leave the scene of the accident. When a driver causes an accident, it is their legal and moral obligation to stop and take responsibility for their negligent actions.

New York Bill Strengthens Penalties for Hit and Run Drivers

On May 7, 2014, the New York Senate passed legislation that increases the penalties for fleeing the scene of an accident when a death, injury or property damage occurs. The bill, which was sponsored by Senator Martin Golden, is aimed at deterring drivers from leaving the scene of an accident and leaving the injured victims on the road.

Under provisions of the bill, hit and run drivers may face Class C Felony charges with a prison sentence of up to 15 years if the victim dies. Repeat hit and run drivers who cause property damage or personal injury may face a Class D Felony. Additionally, the bill increases the penalties from a Class A Misdemeanor to a Class E Felony for failing to stop and report an accident where there was only property damage.
