Raymundo Cruz, Juan Francisco, Actors For Netflix Series ‘The Chosen One’ Killed In Baja California, Mexico Car Accident near Mulege
BAJA CALIFORNIA, MEXICO (June 22, 2022) – Two actors for the Netflix series “The Chosen One” identified as Raymundo Cruz and Juan Francisco have died in a Baja California car accident while in transit from a local airport.
Investigators are saying that the accident took place on June 16. A van carrying Raymundo Cruz and Juan Francisco Aguilar flipped over after running off the road in a desert area.
The Chosen One crew were working in nearby Santa Rosalía at the time of the collision. Despite life-saving measures, Raymundo Cruz and Juan Francisco both died due to their injuries.
The production company for The Chosen One are calling the event an “unfortunate accident.” But a friend of the victims is saying that this tragedy was preventable. Novelist Rick Zazueta took to Facebook to express his thoughts.
“This was no ordinary accident, the cast had been complaining openly about the logistical and transport issues faced in this production, calling it illogical, unreasonable, ignorant, and stupid. The conditions of the van were completely unfit for the purpose of transporting people; worn out tires, noisy brakes, loose steering wheel, not all seat belts worked, easily identifiable signs of danger. But, the show must go on, and the actors get wrapped up in the artform and want to work, and don’t get as many opportunities to work, so they take these gigs with big dreams of Netflix and the promise of a small paycheck,” he said.
Liability In Baja California Movie Production Accidents
The vast majority of accidents in the movie industry are due to lapses in safety protocols. Those lapses in safety protocols are nearly always due to cost cutting measures. It can be very expensive and difficult to run a production company. Most movies fail and the production company has to do their best to keep costs low when that happens. There are a number of ways that producing a movie could become unsafe.
- Actors might not get the proper training to stay safe.
- Stunt workers may not get the equipment they need to be safe.
- Prop masters may not thoroughly vet props that are being used.
- Film crew may not get the certifications they need to handle vehicles or equipment.
- Vehicles that are used may not be properly maintained.
Depending on the facts of any case, there could be numerous liable parties for a movie set production accident. Production companies have a legal responsibility to maintain movie sets in a reasonably safe condition. Many sets involve stunts that are inherently dangerous. Still, no production company is allowed to create a film set that is unreasonably dangerous. To that end, the crew of a movie set should all receive proper safety training for the hazards they will likely encounter.
The company responsible for maintaining a vehicle used on set could also be liable for an accident. Vehicles are complex machines and require periodic maintenance to be driven safely. Any number of problems with a car could potentially turn it into a death trap. This includes faulty brakes and worn tires. There may also be negligence on the part of any company responsible for transporting actors. It has been estimated that 93% of all collisions involve some amount of human error. There are a number of steps that should be taken after any car accident.
- Photos of the accident site should be taken.
- Medical records should be preserved.
- Maintenance records should be preserved.
- A thorough, independent investigation should be conducted.
The family of any victim that died in a movie production accident may have legal recourse through a wrongful death claim. Damages in a wrongful death claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, movie production companies will often fight hard to deny liability for any accident. A movie set production accident attorney can examine all of the facts of your case and let you know what your legal options are.
