The Need to Keep Your Eyes Open For Dangerous Toys

Toys are an important part of every child’s life. Toys are not only objects of desire that make children happy, but they can also play an integral role in your child’s development. However, regardless of whether toys are used for educational purposes or just as a diversion, they must be safe for use.

Unfortunately, not all toys have been deemed safe. In fact, some toys have resulted in serious injuries to the children who have come into contact with them. As a parent, it is very important for us to keep our eyes open for dangerous toys or any toys that could potentially be hazardous to our children’s health and well-being.

Indicators of Unsafe Toys

There are various factors that contribute to a toy’s safety or lack thereof. Some factors to look for in order to determine whether a toy is a safe include:

  • Paint and crayon packages should be labeled with ASTM D-4236, which indicates they have been properly evaluated
  • All art materials should be labeled as nontoxic
  • Stuffed animals should be washable
  • Toys that are constructed of fabric should have labels reading “flame retardant” or “flame resistant”
  • Toys should only be coated with lead-free paint

All toys, whether made in the United States or imported into the country, are monitored by the U.S. Consumer Product Safety Commission (CPSC). Toys are required to adhere to the safety standards set by the CPSC. However, with so many toys introduced into the market each year, it is often difficult for parents to determine which are safe and which are dangerous or questionable.

Your Legal Rights After Getting Injured By an Unsafe Toy

It is all too easy for a child to get injured by an unsafe or defective toy. No toy that is properly used should ever cause a child serious harm. If your child is harmed by a defective or unsafe toy, you have every right to be upset and want to hire an attorney to pursue a legal claim against the manufacturer or distributor. Although filing a legal claim will not undo the harm caused, it can provide a sense of justice and financial relief to obtain medical assistance for your loved one.

A few years ago I was misdiagnosed and nearly ended up becoming a quadriplegic. Three spinal fusions followed. I asked my sister, a top D.C. lawyer, to find the name of the best personal injury lawyer in NYC, and I was referred to Jeff Korek of... Gersowitz Libo and Korek. It was a tough time for me, but Jeff and Irene were great and helped me through it every step of the way. They were compassionate, understanding and very accommodating, yet professional and always with their fingers on the pulse. They really care about the welfare of their clients, and not just money driven. When I was unable to travel, Jeff came to me, and I live an hour from the city. This firm is well known, well established, and has earned the respect and credibility among its peers.
