Liability In New York City MTA Bus Accidents

There are nearly 60,000 bus accidents every year in the United States. Hundreds of people are killed and nearly 14,000 are left with injuries. New York, in particular, has one of the highest instances of bus crashes. There are a number of different factors that could contribute to a fatal bus collision. According to the FMCSA, “Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions.” There are a number of factors that can make buses particularly dangerous.

  • Buses have extremely large blind spots that can obscure the presence of pedestrians.
  • Buses have a long stopping distance due to their weight.
  • Bus drivers are often put under an enormous amount of pressure to complete their routes as quickly as possible. They can easily become fatigued which can compromise their ability to drive safely.

Bus drivers must get a commercial drivers license and are held to a very high standard in terms of safety. When a bus driver hits a pedestrian, they could be at fault through a civil claim. According to New York Vehicle & Traffic Law § 1146(a), drivers must take measures to avoid pedestrians, bicyclists and domestic animals in the roadway. This also means that drivers must operate their vehicle according to the prevailing conditions of the roadway. Generally speaking, drivers should slow down in areas with heavy pedestrian traffic.

If the owner of a bus is a New York municipality, that municipal entity could be held at fault for the collision. As a general principle, corporate and municipal entities in New York are liable for the wrongful actions of their employees. This is true insofar as the tortious conduct was reasonably foreseeable and a natural consequence of the worker’s job duties. The MTA is owned and operated by New York City meaning they could be liable for a negligent MTA bus operator. There are a number of steps that should be taken after an MTA bus accident.

  • Eye witnesses should be interviewed.
  • The bus involved in the crash should be examined.
  • Surveillance footage should be sought.
  • An experienced New York City bus accident attorney should be consulted.

The family of any victim that died in an MTA bus accident may be able to seek justice through a wrongful death claim. Damages can help cover lost wages, medical bills and funeral costs. It is important that evidence is preserved after an accident. Bus companies and the MTA have teams of lawyers that will fight hard to deny responsibility for accidents. A New York city bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, very strict statute of limitations for claims against municipal entities in New York.  A victim’s family must file a notice of claim within 90 days of their loss.
