Nam Phuong Injured In Brooklyn Car Accident On West Second Street

Nam Phuong Critically Injured In Gravesend, Brooklyn Car Accident With Out-Of-Control SUV along West Second Street

Nam Phuong Injured In Brooklyn Pedestrian Accident While Walking Dog

BROOKLYN, NEW YORK (November 10, 2021) – A 14-year-old boy identified as Nam Phuong was seriously injured in a car accident while walking a dog on the sidewalk of West Second Street.

New York City police officials are saying that the accident took place on Tuesday. Nam Phuong  was walking his dog on the sidewalk when he was struck by the driver of an out-of-control SUV.

Police believe that the driver of the Chevy SUV lost their brakes prior to the collision. The SUV pinned the child to the ground and two actors identified as William DeMeo and John Camera stepped in to help the kid by lifting the car off him.

Paramedics arrived at the scene and began life-saving measures. Nam Phuong  was transported to the hospital in critical condition, but has since stabilized.

A full investigation into the collision remains ongoing at this time.

Liability In Gravesend, Brooklyn Brake Failure Accidents

Brake failures are both terrifying and much more common than many people realize. It has been estimated that nearly 300,000 collisions in the United States are due in part to brake failure. In many situations, there is little to no warning that the brakes on a car are about to give out. There are a number of potential factors that could contribute to a brake failure.

  • Moisture in the brake system.
  • Poorly constructed brake hoses.
  • Rusted master brake cylinders.
  • Overheated brake pads.
  • Leaking brake fluid.

Many people will try to claim that an accident was caused by faulty brakes in order to obscure their own negligence. Cars cannot brake on a dime and many collisions are due to drivers that are speeding. Pursuant to New York Vehicle & Traffic Law § 1180, no driver is allowed to operate a vehicle at a speed greater than what is safe given the prevailing conditions of the roadway. But at least some accidents are in fact due to brake problems.

There could be numerous sources of liability for an accident involving a car that experienced a brake failure. Drivers must take reasonable steps to keep their vehicle in working order. This includes periodically taking a car to get inspected and worked on by a mechanic. If a driver did this and a car’s brakes still failed, the company that provided maintenance on the vehicle’s brakes could be liable.

A vehicle manufacturer or the manufacturer of a vehicle’s component parts could be held liable for a brake failure through a product liability claim. Companies in New York have a legal responsibility to create products that are reasonably safe. A car’s brake system may be dangerous if it has a propensity to malfunction. For example, many brake failures are due to manufacturing defects with the brake hoses or pads themselves. There are a number of steps that should be taken after any car accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • A car’s brake system should be examined by a professional.
  • All evidence related to a potentially defective car should be preserved.
  • A full, independent investigation should be conducted.

Any person that is injured in a car accident may be able to seek justice through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Many victims may not realize the full extent of their injuries until several weeks or months after an accident. A car accident attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
