Liability For New Castle School Bus Accidents

School buses are typically very safe for bus passengers. According to the National Transportation Safety Board, “School buses are the safest vehicles on the road, and one of the safest modes of transportation overall. In fact, children are much safer traveling in school buses than in any other vehicle, whether they’re going to and from school, a field trip, or a sporting event. They are even safer riding in a school bus than in a car with their parents or caregivers.” There are a number of common causes of bus accidents.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

Many bus accidents are due to drivers that drive into opposing lanes of traffic. Head-on collisions tend to occur when drivers make unsafe lane changes. If a driver enters into opposing lanes of traffic prior to a crash, this could form the basis of a negligence claim. There are several elements that must be proved in a negligence claim.

  • The defendant owed the plaintiff a legal duty of care.
  • The defendant breached that legal duty of care.
  • The plaintiff suffered an injury.
  • The defendant’s breach was the proximate cause of the injury.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that all evidence is preserved after any collision. Evidence is what will ultimately be needed to demonstrate liability for any crash.
