Liability In Genesee County Motorcycle Accidents
Nearly 5,000 people are killed every year in motorcycle accidents. According to the NHTSA, ‘Per vehicle miles traveled in 2019, motorcyclists were about 29 times more likely than passenger vehicle occupants to die in a motor vehicle crash and were 4 times more likely to be injured. Safe motorcycling takes balance, coordination, and good judgment.” Helmets save lives every year, but this does not make up for the fact that motorcyclists lack the protection of enclosed vehicles. There are a number of factors that could potentially contribute to a motorcycle accident including:
- Distracted driving
- Inclement weather
- Driver fatigue
- Brake failure
All drivers have a legal obligation to exercise due care in order to avoid hitting other vehicles. Intersections are one of the most common locations of accidents because they can be tricky to navigate. According to New York Vehicle & Traffic Law 1140, drivers must yield the right of way to vehicles that entered the intersection from a different highway. When a driver fails to exercise caution and strikes a motorcyclist they can be held at fault through a civil claim.
Depending on the specific facts of any case liability for a motorcycle collision could extend beyond any driver. Pickup trucks are often used in construction, landscaping and moving. If a pickup truck driver was working at the time of a collision the company that they were working for could be held at fault. Companies are typically liable for the wrongful acts of their employees – insofar as the negligent act was generally foreseeable and a natural occurrence of the worker’s job. Victims of motorcycle accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Organ damage
- Spinal cord injuries
Even after the physical injuries of an accident have healed victims are often left with very serious psychological trauma. In fact, the National Institute of Mental Health (NIMH) estimates that nearly 40% of car accident survivors develop PTSD. Any person that is injured in a motorcycle accident may be able to seek justice through a bodily injury claim. Damage in a civil claim can help cover lost wages, medical bills and pain and suffering. A Genesee County motorcycle accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
