Liability In Staten Island Car Accidents
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, drivers must take measures to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a driver goes past a yield sign without stopping, they will typically be held at fault in the event of a collision. There are a number of steps that should be taken after any collision.
- Photos of the accident site should be taken.
- Medical records should be preserved.
- Eye witnesses should be interviewed.
The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering.
