Liability In Queens Motorcycle Accidents
Motorcycles have a naturally small profile and their riders lack the protection of enclosed vehicles. According to the Insurance Information Institute, “Motorcycles are by their nature far less crashworthy than closed vehicles. They are also less visible to other drivers and pedestrians and less stable than four-wheel vehicles.” There are a number of steps that drivers can take in order to avoid hitting motorcyclists.
- Drivers should always check their blind spots when turning or changing lanes.
- Drivers should avoid driving right alongside motorcyclists.
- Drivers should maintain a safe distance behind motorcyclists and other vehicles.
All drivers have a legal obligation to exercise due care in order to avoid hitting motorcyclists. A large number of collisions are due to drivers that make dangerous left turns. Pursuant to New York Vehicle Code § 1141, any driver intending to turn left must yield the right of way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard. Victims of motorcycle accidents tend to suffer very serious and costly injuries including.
- Broken bones
- Head injuries
- Organ damage
Any person that is injured in a collision may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Many victims may not realize the full extent of their injuries for many weeks or months after an accident. A New York City motorcycle accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
