Liability In Lakewood Bus Accidents

Pedestrians are uniquely vulnerable in bus collisions. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to one report by the Federal Motor Carrier Safety Administration (FMCSA), “In 2018, 5,096 large trucks and buses were involved in fatal crashes, a 1-percent increase from 2017.” Elderly pedestrians and small children tend to be at the greatest risk. There are a number of factors that could potentially contribute to a bus accident including:

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver intoxication

All bus drivers must receive training and get a commercial driver’s license. As such, they are held to a high standard in terms of safety. When a bus driver fails to exercise due care and strikes a pedestrian, the company or municipality that they were working for could be held at fault. If the bus was owned by the NJ Transit agency or another municipal entity, victims or their families must file a Notice of Claim within 90 days. Victims of bus accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Spinal cord trauma
  • Lacerations

The family of any victim that died in a NJ Transit bus accident may be able to seek damages through a wrongful death claim. It is important that evidence is properly preserved after any collision. Among other things, bus companies often fight hard to deny liability for any accidents involving their drivers. A New Jersey bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
