Liability For Hudson Valley Pedestrian Accidents
Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Governors Highway Safety Association (GHSA), “Drivers struck and killed an estimated 7,485 people on foot in 2021 – the most pedestrian deaths in a single year in four decades and an average of 20 deaths every day.” The vast majority of pedestrian accidents are totally preventable.
- Drivers may be traveling too close to the curb.
- Drivers may be under the influence of alcohol or drugs.
- Drivers may have failed to slow down to prevent a collision.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. The family of any person that died in a pedestrian accident may be able to seek some measure of justice through a wrongful death claim.
