Buses are among the safest forms of transportation available. But they pose many unique hazards to pedestrians and those in passenger vehicles. According to one report by the FMCSA, ” From 2018 to 2019, large truck and bus fatalities per 100 million vehicle miles traveled by all motor vehicles declined from 0.162 to 0.161, 21 percent below the 21st-century peak of 0.205 in 2000.” There are a number of different factors that could potentially contribute to a bus accident.

  • Commercial buses have large blind spots that can easily obscure the presence of pedestrians.
  • Bus drivers are often forced to work long hours and may naturally become fatigued.
  • Buses take much longer to stop than passenger vehicles. This is why it is important for bus drivers to constantly monitor the road ahead of them.

Bus drivers must obtain a commercial driver’s license (CDL). They are therefore held to a high standard in terms of safety. CDL holders must undergo special training and are expected to do everything in their power to avoid accidents. Pursuant to New York Vehicle & Traffic Law § 1146(a), all drivers must exercise due care in order to avoid hitting pedestrians. They should also sound their horn when necessary to alert others of their presence.

Bus drivers must also operate their vehicle according to the prevailing conditions of the roadway. As outlined in New York Vehicle & Traffic Law § 1180, no driver may operate their vehicle at a speed greater than what would be reasonable and safe given the conditions and hazards of the roadway. During times of reduced visibility or inclement weather drivers must reduce their speed to help prevent collisions.

If a bus driver is negligent and hits a pedestrian the company that they work for could be held at fault. Generally speaking, companies are liable for the negligent actions of their employees – insofar as the tortious conduct was reasonably foreseeable and within the scope of the worker’s duties. If the bus was owned by a city or county, that government entity could be held at fault. There are many steps that should be taken after any collision.

  • Photos of the accident site should be taken.
  • The bus driver involved should be interviewed.
  • Surveillance footage of the accident should be sought.
  • Maintenance records of the bus should be examined.

The family of any victim that died in a bus accident may be able to seek some measure of justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral costs. It is extremely important that evidence preserved after an accident. Bus companies will often fight extremely hard to deny any responsibility for a collision.
