They must be particularly cautious when initiating a turn. Pursuant to NY Veh & Traf L § 1141, “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard.” Certain actions should be taken after any ambulance accident. The police report for the incident should be collected. All medical records related to the accident should be reviewed.Surveillance footage that may have captured the crash should be sought. The family of any person who died should seek an independent review by a team experienced in accident claims. If an ambulance driver makes an unsafe turn and collides with a pedestrian, this could form the basis of a negligence claim. Even if a pedestrian is in the middle of the road, this does not relieve a driver of their responsibility to slow down to avoid a collision. When an ambulance is involved in a collision, their employer could also be liable. As a general rule, employers in New York can be vicariously liable for the negligent actions of their workers who are operating within the course and scope of their job duties.Investigating Brooklyn Car AccidentsWe at GLK Law extend our deepest condolences to the family of the man killed in this Fort Greene collision.
