Liability For Brighton Bicycle Accidents
Bicyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the CDC, “Bicycle trips make up only 1% of all trips in the United States.1 However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads.” There are a number of factors that could contribute to a bicycle accident.
- Speeding
- Inclement weather
- Poor road conditions
- Driver fatigue
All drivers have a legal obligation to exercise due care in order to avoid hitting bicyclists. They must slow down and maintain at least three feet of separation from bicyclists at all times. If a driver fails to exercise due care and hits a bicyclist, this could form the basis of a negligence claim. The family of any person that died in a bicycle accident may have legal recourse through a civil claim.
