Liability For Upper East Side Truck Accidents

Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Governors Highway Safety Association (GHSA), “Drivers struck and killed an estimated 7,485 people on foot in 2021 – the most pedestrian deaths in a single year in four decades and an average of 20 deaths every day.” Many pedestrian accidents are totally preventable.

  • Drivers may be distracted by their phones.
  • Drivers may be intoxicated by alcohol or some substance.
  • Drivers may be fatigued after working a long shift.

All truck drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a driver fails to reduce their speed in order to avoid a collision, this could form the basis of a negligence claim. There are many steps that should be taken after any pedestrian accident.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

It can be hard to know where to begin after any accident. Many accident victims suffer life-altering injuries and may not be able to return to work. Any person that is injured in a car accident may have legal recourse through a bodily injury claim. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
