Liability In Queens Truck Accidents

Commercial trucks can be particularly dangerous to smaller vehicles. They can weigh 20 – 30 times more than a passenger vehicle. Most commercial trucks also have a high ground clearance which makes underride collisions more likely. Operating a commercial truck requires a different set of skills and knowledge than operating a passenger vehicle. Commercial truck drivers are also put under numerous stresses most people don’t have to deal with.

  • They often must drive at night or at odd hours when they would naturally be tired.
  • They are pushed to work long hours which can also make them tired.
  • Truck drivers must constantly check their blind spots which are typically quite large.

All truck drivers are expected to operate their vehicle with due care in order to avoid collisions. A large number of collisions are due to truck drivers that fail to check their blind spots and make dangerous turns. According to New York Vehicle Code § 1141, “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard.” Victims of semi-truck accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Spinal cord injuries
  • Lacerations
  • Head injuries
  • Organ damage

Any person that is injured in a truck accident may be able to seek damages through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. The FMCSA requires most commercial trucks to carry liability policies between $750,000 – $5,000,000. A New York City truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
