Liability In Bronx Dump Truck Accidents
Despite numerous steps to improve pedestrian safety, far too many pedestrians are injured or killed every year in New York City. According to one report from the New York Post, “Pedestrian deaths in the city have surged 58 percent so far this year compared to the same period in 2020 — to 41 deaths from 26 — despite Mayor de Blasio’s “Vision Zero” program to make city streets less dangerous for walkers.” There are a number of factors that could potentially contribute to a pedestrian collision including:
- Distracted driving
- Driver intoxication
- Dangerous left turns
All drivers must exercise due care in order to avoid hitting pedestrians. Many pedestrian collisions occur when drivers make dangerous turns in the roadway. When a driver fails to yield to a pedestrian, they can face fines and jail time under New York Vehicle and Traffic Law §1112. The company that owned a dump truck that hit a pedestrian could be held liable through a civil claim. Generally speaking, companies are vicariously liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties.
A city or municipality in New York could potentially be liable for a pedestrian accident. Cities and municipal entities have a legal obligation to maintain their roadways and intersections in a reasonably safe condition. When a municipal entity receives written notice of a dangerous condition with a roadway they must conduct a study and then potentially take corrective action. Failure to take corrective action could form the basis of a negligence claim. There are a number of steps that should be taken after any dump truck accident.
- Surveillance footage should be sought.
- It should be determined if there has been a history of accidents where the collision took place.
- Eye witnesses should be interviewed.
- A thorough, independent investigation should be conducted.
The family of any victim that died in a dump truck accident may have legal recourse through N.Y. Est. Powers & Trusts Law § 5-4.1 (2021). Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. It is extremely important that evidence is preserved after any accident. Evidence is what will ultimately be used to determine liability. A New York City wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
