Liability In Pine Plains Home Explosions
While there are many potential factors that could contribute to a residential home explosion, natural gas is by far the most common. Over 4,000 home fires every year are due to natural gas explosions. According to the National Fire Protection Association (NFPA), “Local fire departments responded to an average of 125,000 natural gas or LP-Gas leaks per year that did not result in fires in or at home properties in 2012-2016. Since 2007, these incidents have generally been increasing.” There are a number of potential factors that could contribute to a natural gas explosion.
- Appliances such as furnaces may not be properly installed, which could lead to a leak.
- Worn gas lines could rupture and lead to a leak.
- Defective equipment such as gas grills could potentially leak gas and cause an explosion.
Explosions tend to happen when gas builds up in an enclosed area. This is why natural gas explosions are much more common during the winter months. If you ever smell gas inside of your home, there are a number of steps that you should take. Leave as quickly as possible and don’t turn on any lights on the way out. Turning on a light could potentially trigger an explosion . Leave the door open for ventilation. Call police as quickly as you can.
Depending on the facts of any case, there could be numerous sources of liability for a home explosion accident. A gas company could potentially be liable if they failed to maintain their premises in a reasonably safe condition. Property owners in New York must take action to remedy a dangerous condition on their property when they receive actual or constructive notice of that dangerous condition. Failure to remedy a dangerous condition could result in liability in the event of an injury or death.
Consider, for example, the East Harlem natural gas explosion in 2014. Eight people were killed and 50 people were injured after a gas line suddenly ruptured. A lawsuit was brought by the families of the deceased and the injured. It was discovered by the National Transportation Safety Board that the explosion was likely caused by a faulty connection between two Con Edison gas pipes. There was also a hole in a nearby sewer line that the city knew about for at least 8 years. Attorneys for the plaintiffs secured a $153 million settlement and Con Edison vowed to implement additional safety measures. Victims of gas explosions tend to suffer very serious injuries including:
- Broken bones
- First, second and third degree burns
- Head injuries
- Organ damage
- Ear drum ruptures
The family of any victim that died in a home explosion may be able to seek justice through a wrongful death claim. Victims that survive may be able to seek justice through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. It is extremely important that there is a thorough investigation after any explosion. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.

Are the gas lines in the area well-maintained? Could this tragedy have been prevented? The vast majority of home explosions can be prevented when public utilities put an emphasis on safety. Far too often, the desire to maximize profits leads to corner cutting that jeopardizes the public.
