Rochester police officials are saying that the accident took place on Tuesday, December 21st. Khadijah Stanley was walking when an SUV drove onto the sidewalk and hit her.

Liability In Rochester DUI Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to one report from the NHTSA, “Every day, about 28 people in the United States die in drunk-driving crashes — that’s one person every 52 minutes. In 2019, these deaths reached the lowest percentage since 1982 when NHTSA started reporting alcohol data — but still 10,142 people lost their lives.” Sadly, DUI accidents tend to spike around the holidays. Even small amounts of alcohol can substantially impair drivers in the following ways.

  • Reduced coordination
  • Loss of muscle control
  • Lowered alertness
  • Difficulty tracking lane lines

It is illegal to operate a motor vehicle under the influence of alcohol or drugs. According to New York Vehicle and Traffic Law § 1192, no person shall operate a motor vehicle with a BAC of 0.08% or higher. Commercial drivers must not drive with a BAC of 0.02% or higher. Drivers that hit pedestrians while intoxicated can be held accountable through a criminal and civil claim. There are a number of steps that should be taken after any pedestrian collision.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • A thorough investigation should be conducted.

The family of any victim that died in a car accident with a drunk driver may be able to seek justice through a wrongful death claim. Damages can help cover lost wages, medical bills and funeral expenses. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
