Liability For Theresa Truck Accidents
Thousands of people are killed or seriously injured every year in truck accidents. These collisions take place for many different reasons. According to the Federal Motor Carrier Safety Administration, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are a number of steps that all drivers should take in order to avoid collisions.
- Drivers should slow down during periods of reduced visibility.
- Drivers should abstain from alcohol and drugs.
- Drivers should maintain a safe distance with the vehicles ahead of them.
All drivers have a legal obligation to exercise due care in order to avoid causing collisions. A large number of car accidents are due to speeding. Drivers must not operate their vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane of traffic. There are a number of steps that should be taken after any car accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- Photos of the accident site should be taken.
The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. It is common for drivers to deny liability if they are involved in a collision. This is why it is so important that all evidence is properly preserved after a crash.
