Jongwon Choi Died In North Hills Bicycle Accident Involving FedEx Truck By Searingtown Road

Jongwon Choi Killed In North Hills FedEx Truck Accident By Searingtown Road

NORTH HILLS, NEW YORK (October 3, 2022) – A bicyclist identified as Jongwon Choi has tragically died in a North Hills FedEx truck accident on  Searingtown Road.

North Hills police officials are saying that the accident took place on Tuesday morning. Jongwon Choi was riding a bicycle west of North Service Road when he was hit by a FedEx truck.

The driver of the FedEx truck remained at the scene and cooperated with authorities.

Liability In North Hills FedEx Truck Accidents

Large trucks are essential for the economy, but they also pose a number of unique hazards for bicyclists and pedestrians. According to the Federal Motor Carrier Safety Administration FMCSA, “In 2019, 4,805 large trucks were involved in fatal crashes. According to MCMIS, 60,744 large trucks were involved in injury crashes, and 110,256 were involved in towaway crashes.” There are a number of factors that could potentially contribute to a FedEx truck accident.

  • Speeding
  • Drunk driving
  • Driver intoxication
  • Inclement weather

All drivers must exercise due care in order to avoid hitting bicyclists. Commercial drivers will typically need a commercial driver’s license and are held to a high standard in terms of  safety. Pursuant to New York Vehicle & Traffic Law § 1146(a), all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a FedEx truck driver failed to slow down and hit a bicyclist, this could form the basis of a negligence claim.

When a FedEx truck driver is negligent and hits a bicyclist, their employer could be held at fault for the collision. Generally speaking, companies are liable for the negligent actions of their employees – insofar as the tortious conduct was reasonably foreseeable and a natural consequence of the worker’s employment. There are a number of steps that should be taken after any accident involving a FedEx truck.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.
  • A thorough, independent investigation should be conducted.

The family of any pedestrian that died in a collision may have legal recourse through N.Y. Est. Powers & Trusts Law § 5-4.1 (2021). Damages in a civil claim can help cover many of the unexpected expenses that can come with the sudden loss of a loved one. Sadly, though, truck companies will often fight extremely hard to deny liability for an accident. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
