Liability In New York City Workplace Accidents

Thousands of workers are seriously injured or killed on the job every year. The construction industry, in particular, can be especially dangerous. The Occupational Safety & Health Administration (OSHA), lists four type of accidents in particular that make up the vast majority of workplace deaths. These four types of accidents are falls, electrocutions, struck by objects and caught-in/between accidents. There are a number of steps that companies can take to help keep workers safe.

  • Workers should be properly trained.
  • Work sites should be maintained in a reasonably safe condition.
  • Workers should always communicate with one another.

When a worker is injured on the job, they may have recourse through a civil claim. A large portion of workplace accidents are totally preventable. A construction company could be liable for a worker’s death under  New York Labor Law 241(6). This statute creates a non-delegable duty for companies engaged in construction, demolition, and excavation. If a construction company violated a specific safety code this could establish fault for an accident. There are a number of steps that should be taken after any workplace accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.

The family of any worker that dies on the job may be able to seek damages through a civil claim. Damages can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are. It is important that evidence is properly preserved after any accident.
