Liability In Onondaga County DUI Car Accidents

Thousands of people are killed or seriously injured every year due to the negligence of drunk drivers. According to the National Highway Traffic Safety Administration (NHTSA), “Every day, about 28 people in the United States die in drunk-driving crashes — that’s one person every 52 minutes. In 2019, these deaths reached the lowest percentage since 1982 when NHTSA started reporting alcohol data — but still 10,142 people lost their lives.” Even moderate amounts of alcohol can substantially impair drivers in the following ways.

  • Delayed reaction times
  • Reduced coordination
  • Lowered inhibitions
  • Lowered alertness

When the victim of a car accident was working at the time of a collision, they may have recourse through the worker’s compensation system. Worker’s compensation is a no-fault system in New York. It can help cover disability benefits and medical expenses. Depending on the specific facts of any case, an injured worker may also be able to seek damages through a third party liability claim. A third party liability claim may be possible when an entity separate from a worker’s employer caused an accident.

An intoxicated driver could be held at fault through a civil claim. It is illegal to operate a motor vehicle under the influence of alcohol or drugs. No driver is allowed to operate a motor vehicle with a blood alcohol content of 0.08% or higher. Commercial drivers are held to an even higher standard. They can’t drive with a bac of 0.04% or higher. Even prescription medications can potentially impair someone so that they become unfit to drive.

If an intoxicated driver was working at the time of a collision, the company that they work for could potentially be held at fault. Generally speaking, employers are vicariously liable for the negligent actions of their employees. This is typically true as long as the negligent conduct was a natural consequence of their job duties. For example, a driver could have been driving to a meeting or delivering a package when an accident took place. There are a number of steps that should be taken after any collision.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • An experienced personal injury attorney should be contacted.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A New York personal injury attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations to keep in mind.
