According to one report from the AAA Foundation for Traffic Safety, “There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds.” A large portion of hit-and-run collisions are due to drivers that are under the influence of alcohol or drugs. But there are a number of factors that could potentially contribute to a hit-and-run collision.
- Distracted driving
- Prescription drugs
- Inclement weather
Drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle & Traffic Law § 1146(a), drivers must take steps to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. Drivers that flee the scene of any collision that results in bodily injury or death could be held accountable through both a criminal claim as well as a civil claim.
