Liability In Watertown Attic Falls

Falls are one of the leading causes of serious injury for children. According to one report from the Stanford Children’s Hospital, over 2.2 million children are sent to the emergency room every year in order to be treated for fall related injuries. Children under 10 years of age tend to be at the greatest risk. Victims of fall accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Spinal cord injuries
  • Organ damage

Property owners in New York have a legal responsibility to maintain their property in a reasonably safe condition. This must be done for all people whose presence on a property is reasonably foreseeable. When a property owner is aware of a dangerous condition on their property they must take reasonable measures to correct that dangerous condition. Failing to correct a dangerous condition could form the basis of a negligence claim. There are a many steps that can be taken to prevent accidental falls.

  • Areas that could be potentially dangerous should be sealed off.
  • Property owners should do periodic maintenance on their property.
  • Warning signs should be placed in areas that could be hazardous.

Many victims don’t realize the full extent of their injuries until several weeks or months after they are injured. Victims may be able to seek aid through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, insurance companies will often fight extremely hard to deny liability for an accident. A premises liability attorney can examine the unique facts of your case and let you know what your legal options are.
