Liability In Rikers Island Inmate Deaths

Far too many inmates die every year in the United States. According to Prison Legal News, “Overall, illness was the cause of death for 87% of state and 90% of federal prisoners in 2018. Suicide accounted for 6% of state and 5% of federal prisoner deaths. Homicide amounted to 2% of state and nearly 3% of federal prisoner deaths. 61% of the state prisoners who died in 2018 were over 54, a dramatic increase from the 34% in 2001.” There are a number of steps that prisons should take in order to keep inmates safe.

  • Correctional officers should be properly trained.
  • Prisons should be properly staffed.
  • Inmates should receive adequate healthcare.

Depending on the specific facts of any case, a prison could be liable for an inmate dying in their care. Inmates have a constitutional right to receive reasonably adequate healthcare. If a prison is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a negligence claim. There are a number of steps that should be taken after any inmate’s death.

  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in custody may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that evidence is preserved after an accident. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
